1.1 Binding Agreement

These Terms constitute a legally binding agreement between you and the developer(s) of ProSearch Tools. By using the Extension, you acknowledge that you have read, understood, and agree to comply with all provisions of these Terms.

1.2 Modification of Terms

We reserve the right to update or modify these Terms at any time. Any changes will become effective immediately upon posting the revised Terms. Your continued use of the Extension following any modifications constitutes acceptance of the revised Terms. We will make reasonable efforts to notify you of significant changes through the Extension interface or email.

2.1 Primary Functionality

ProSearch Tools is a Chrome extension designed to enhance your search experience with the following features:

• Split-Screen Viewing: Opens search results and selected links side-by-side for enhanced productivity
• Multi-Monitor Support (Premium): Distributes search windows across multiple monitors
• Domain Filtering: Allows you to hide unwanted domains from search results
• Search History (Limited for Free Users): Tracks and organizes your search activity
• Keyword Highlighting (Premium): Automatically highlights search terms on visited pages
• Keyboard Shortcuts: Includes "Hold that thought," "Eureka!," and "Take a break!" for quick actions
• Copy with Citation: Allows copying text with automatic source citation

2.2 Free vs. Premium Features

The Extension offers both free and premium features:

• Free Features: Basic split-screen functionality, domain filtering, keyboard shortcuts, limited search history (5 most recent searches for up to 5 search phrases)
• Premium Features: Multi-monitor support, unlimited search history with cross-device syncing via Google Drive, keyword highlighting, advanced screen management

2.3 Browser Compatibility

ProSearch Tools is designed to work with Google Chrome and may be compatible with some Chromium-based browsers (like Edge or Brave). The Extension uses Chrome-specific APIs including:

• Chrome Identity API for authentication
• Chrome Storage API for saving preferences
• Chrome Windows and Tabs APIs for split-screen functionality
• Chrome System Display API for multi-monitor support

2.4 System Requirements

To use ProSearch Tools effectively:

• Google Chrome browser (latest version recommended)
• For multi-monitor support: Multiple display setup and system permissions to detect displays
• For Premium features: Valid Google account for authentication and syncing

3.1 Google Authentication

To access certain features, you must sign in using your Google account. By signing in, you:

• Authorize us to access your basic Google account information (email, display name, user ID)
• Grant the Extension permission to use Google Drive for data syncing (Premium users only)
• Allow authentication through Firebase services for account management

3.2 Data Storage and Syncing

Your data is stored in different locations depending on your subscription level:

• Local Storage: Extension settings, preferences, and free user search history
• Chrome Sync Storage: Hidden domain preferences
• Google Drive (Premium): Search history for syncing across devices
• Firebase: Account authentication and subscription status

3.3 Account Security

You are responsible for:

• Maintaining the security of your Google account credentials
• Notifying us immediately of any unauthorized access to your account
• Ensuring you sign out of shared devices

We implement industry-standard security measures but cannot guarantee the security of third-party services like Google Authentication.

4.1 Subscription Tiers

ProSearch Tools offers the following subscription options:

All payments are processed securely through Stripe:

• We do not collect or store your payment details
• All payment information is handled directly by Stripe
• Subscriptions automatically renew until cancelled

4.3 Billing and Cancellation

Regarding your subscription:

• Subscription fees are charged at the beginning of each billing period
• You may cancel your subscription at any time through our customer portal
• Upon cancellation, you will maintain Premium access until the end of your current billing period
• No refunds are provided for partial subscription periods or for unused portions of your subscription
• If you cancel during a free trial period, you will not be charged

4.4 Changes to Pricing

We reserve the right to change our subscription pricing at any time. If we do so:

• Price changes will be communicated to you at least 30 days in advance
• New prices will only apply to subscription renewals, not to your current billing period
• You will have the opportunity to cancel your subscription before any price change takes effect

5.1 License to Use

We grant you a personal, non-transferable, non-exclusive, revocable license to use the Extension in accordance with these Terms. This license does not give you ownership of the Extension but allows you to use it as long as this agreement remains in effect.

5.2 Intellectual Property Rights

All intellectual property rights, including copyrights, trademarks, and patents related to the Extension, remain the property of ProSearch Tools and its licensors. The Extension's code, design, functionality, and content are protected by copyright and other intellectual property laws.

5.3 Restrictions

You may not:

• Copy, modify, or create derivative works based on the Extension
• Reverse engineer, decompile, or disassemble the Extension
• Remove or alter any copyright, trademark, or other proprietary notices
• Rent, lease, lend, sell, redistribute, or sublicense the Extension
• Use the Extension for any illegal, harmful, or unauthorized purposes

6.1 Acceptable Use

When using ProSearch Tools, you agree to:

• Use the Extension in compliance with all applicable laws and regulations
• Not use the Extension to infringe on others' intellectual property rights
• Not attempt to gain unauthorized access to any part of the Extension or its systems
• Not use the Extension to distribute malware or harmful code
• Not interfere with or disrupt the Extension's functionality

6.2 Content Responsibility

You are solely responsible for:

• Any websites you visit using the Extension
• Any search queries you enter
• Any content you access, copy, or share through the Extension
• Ensuring your use of the Extension does not violate any third-party terms of service

6.3 Feedback and Suggestions

If you provide feedback or suggestions regarding the Extension:

• We may use this feedback to improve the Extension without any obligation to you
• You grant us a non-exclusive, perpetual, irrevocable, transferable, worldwide license to use your feedback for any purpose

7.1 Google Services

The Extension integrates with various Google services:

• Google Authentication: For user identity and login
• Google Drive API: For syncing Premium user data across devices
• Chrome API: For browser integration and functionality

Your use of these Google services is subject to Google's Terms of Service and Privacy Policy.

7.2 Firebase

We use Firebase for:

• User authentication
• Subscription management
• Backend infrastructure

Firebase is subject to Google's Terms of Service and Privacy Policy.

7.3 Stripe

We use Stripe for payment processing. When making payments:

• Your payment information is collected and processed directly by Stripe
• Your use of Stripe's services is subject to Stripe's Terms of Service and Privacy Policy
• We do not store your full payment details

7.4 Third-Party Content

The Extension allows you to access third-party websites and content. We are not responsible for:

• The accuracy, legality, or appropriateness of third-party content
• Any damages resulting from your use of third-party websites
• Privacy practices or security measures of third-party websites

8.1 Disclaimer of Warranties

The Extension is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Availability, reliability, or accuracy

We do not warrant that the Extension will function uninterrupted, error-free, or that defects will be corrected.

8.2 Limitation of Liability

In no event shall ProSearch Tools, its developers, officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages for system failure or malfunction
• Any damages resulting from unauthorized access to your data
• Any damages resulting from interrupted or unavailable service
• Any damages resulting from your use or inability to use the Extension

This limitation applies regardless of whether the damages arise from breach of contract, tort, or any other legal theory, and even if we have been advised of the possibility of such damages.

8.3 Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages, so some of the above limitations may not apply to you.

9.1 Termination by You

You may terminate your use of the Extension at any time by:

• Uninstalling the Extension from your browser
• Cancelling your Premium subscription through the customer portal (if applicable)
• Signing out of your account within the Extension

9.2 Termination by Us

We reserve the right to suspend or terminate your access to the Extension at any time without prior notice for any reason, including but not limited to:

• Violation of these Terms
• Using the Extension for illegal or unauthorized purposes
• Failure to pay subscription fees
• Requests from law enforcement or government agencies
• Extended periods of inactivity
• Unexpected technical issues or security concerns

9.3 Effect of Termination

Upon termination:

• Your right to use the Extension will immediately cease
• Your locally stored data will remain until you clear your browser extension data
• Premium users' synced data will remain in their Google Drive until explicitly deleted
• We may delete your account information from our servers
• Any outstanding payment obligations will survive termination

Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we are located, without regard to its conflict of law provisions.

10.2 Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Extension, we encourage you to first contact us directly to seek an informal resolution.

If we cannot resolve the dispute informally, both parties agree to attempt to resolve the dispute through mediation before resorting to arbitration, litigation, or some other dispute resolution procedure.

10.3 Limitation on Time to File Claims

Any cause of action or claim you may have arising out of or relating to these Terms or the Extension must be commenced within one (1) year after the cause of action accrues, otherwise, such cause of action or claim is permanently barred.
